Disertasi: EKSISTENSI NILAI-NILAI ETIKA DALAM SISTEM OPERASIONAL PERBANKAN SYARIAH Studi pada Bank Muamalat Indonesia (BMI) Cabang Kendari


Targets that wish reached pass by this dissertation is to know formulation
and implementation of ethics values; and to give constructive solution in order to
maximize implementation of ethics values in operational system of shariah banking
at BMI Kendari Branch.
Research of this dissertation using technique of descriptive qualitative
analysis and go throughs analysis steps begin at the study of data, reduction of data,
category of data, interpretation of data, and conclusion of data.
Ethics values are matter esensial that explorated from nash-nash al-Quran
and al-Sunnah as the philosophic base, then formulated in the form of ethics
principles as the base sociology by emerge a number of actions that contain ethics of
norms have the shape of command, prohibition order, or ability conducts an action.
The ethics norms to become as the base praxis and value of instrumental system in
operationalization of shariah banking.
The result of research this dissertation to give that formulation of ethics
norms namely: a) command to leave usury; b) suggestion to do transaction with
voluntarily; c) ability to give free-bussines; d) prohibiton to do deception; e)
prohibiton to do gembling; f) command to do honesty and believable; g) ability or
suggestion to give the gift and profit sharing; h) command to give sanction; i) ability
or suggestion to give guarantee; and j) ability to clear debit and credit.
Those are ethics norms become positive law values because has codivicated
into form law regulation about: a) forbidden usury by means of MUI instruction; b)
transaction with the contract; c) taking measures to deception and gambling; d)
giving sanction to infraction of law; and e) giving guarantee poured forth to the
contract.
Ethics values namely Ilahiah, Khilafah, Tawazun, ‘Adalah, Maslahah Values,
and its derivation by ethics principles and norms has not yet maximal
implementation at BMI Kendari Branch. Not yet maximal implementation these are
ethics norms because there are two constraints; constraints by managerialinstitusional and constraints by personal-individual. Managerial-institusional
constraint to connected by have not yet the sanction of expressly, professionalism in
compilation of sharing holder system, stakeholders participation, skill of human
resources, limitation of service unit offices; and transparency problem. Personalindividual constraint to connected by personality integrity officers and client
bussines.
The solution that should be conducted by BMI Kendari Branch in
maximizing the implementation values, principles, and ethics norms at its
operational system is: a) not mutually throw responsibility; b) administration
management that professional; c) conduct tight control to partner institute; d) run
what has been agreed on previous obligingly without tend to detrimental client; e)
promotion must be done squarely and correctness; and f) improvement of
observation intensity.
